Commentary: Fair Consideration Framework (FCF) - What Is It and How Does It Affect You As An Employer?

When and why was Fair Consideration Framework (FCF) implemented?


What are the dos and don’ts as an employer in Singapore? 


Let’s learn about FCF and how the guidelines may impact your hiring or workforce management as an employer.


The FCF was introduced in 2014 by the Ministry of Manpower (MOM) in response to concerns about the limited opportunities for Singaporeans in the job market, particularly in certain industries and sectors. It sets out requirements for all employers in Singapore to consider the workforce in Singapore fairly for job opportunities. Employers should not discriminate against candidates based on non job-related characteristics, such as age, sex, nationality or race.


Here are some pointers to take note of when hiring:

  • Post a well-written job advertisement to attract the right talent

  • Job Description should be clear and accurate reflecting job title, responsibilities and requirements (required/ preferred qualifications, skills and working conditions) which would contribute to succeeding in the role. It should be competency-based and non-discriminatory.

  • To promote fair employment practices and improve labour market transparency, employers are strongly encouraged to advertise on MyCareersFuture and fairly consider all candidates. It is mandatory if employers are submitting Employment Pass or S Pass applications. Find out more about the FCF job advertising requirements for Employment Pass and S Pass.

  • Bear in mind to assess applicants based on job requirements when screening their profiles and interviewing them; selection criteria should be competency-based and non-discriminatory.

  • Practise fair hiring regardless of which recruitment channels are used. The above practices should also apply to internal hiring/ movement. MOM will take action against employers who do not adhere to the Tripartite Guidelines on Fair Employment Practices.


We would like to reiterate that the FCF also applies to employees in your organisation - any discriminatory HR practices or conduct could be reported to Tripartite Alliance for Fair and Progressive Employment Practices (TAFEP) as workplace discrimination.


Over the years, the FCF remains as one of the hot topics where hiring or matters pertaining to the workforce are concerned. We have spotted some articles and according to Mothership in 2022, The Business Times in 2020, Channel News Asia in 2018 and The Straits Times in 2016, there were approximately 250 to 400 firms on the watchlist for foreign hiring practices. MOM has taken action against those found guilty for unfair practices.


All employers in Singapore are expected to adhere to the Tripartite Guidelines on Fair Employment Practices and there are short videos/ commercials to create awareness and act as a reminder to ensure the right practices are in place.
